"Jason Stverak, president of the Franklin Center for Government and Public Integrity, recently wrote a Washington Examiner op-ed regarding the free speech threats which bloggers and other citizen journalists increasingly face.

This past December, federal judge Marco Hernandez of Oregon issued a ruling in the libel trial of Obsidian Finance Group v. Cox that has dangerous First Amendment implications.

Hernandez ruled that blogger Crystal Cox was not entitled to the same protection under media shield laws that other members of the press enjoy. This ruling made it easy for a jury to find her guilty of libel. That result threatens the First Amendment rights of all citizen-journalists.

With the Internet increasingly serving as the dominant source of information, a national debate has been taking place asking the question, who is a journalist? Legal scholars, journalism academics and First Amendment advocates all have their opinions and as expected, there is little agreement.

But why is this issue so complicated? Bloggers, like all citizens of the United States, have First Amendment rights. Has the definition of a journalist changed? Or has perception and therefore legal definition simply not adjusted to modern technology?

According to Professor Kyu Ho Youm of the University of Oregon School of Journalism and Communication, Judge Hernandez “ruled correctly” in the Cox case. But he also acknowledges that the ruling was based on his “textual interpretation” and that “pre-Internet law needs updating.”

Youm offers a wake-up call to state legislators. Media shield laws must be revised to make clear that bloggers and all citizen-journalists deserve the same protection as the city hall beat-writer at the local newspaper.

This is especially important, as technology and new economic realities have forced newspapers all over the country to cut staff drastically and in many cases, close up shop. The public now relies on citizen-journalists to perform an invaluable service to our democracy — serving as government watchdogs.

New York Times reporters David Carr and Amy Chozick started working on their Philadelphia newspapers story on Sunday, and heard “persistent reports” of a meeting taking place during which Philadelphia Media Network CEO Greg Osberg told editors that he’d be overseeing articles about the impending sale of the Inquirer and Daily News."

"“I got in touch with [PMN spokesman] Mark Block on Tuesday,” Carr says in a phone interview. “He was spinning some, but he was helpful and direct and he was also trying to keep his boss’s exposure sort of at a minimum. I knew Osberg from his time at Newsweek and had always had good dealings with him. I heard some bad things [from Philadelphia sources], but I had an open mind about talking with him.”

By Wednesday morning, Chozick and Carr had multiple sources confirming Osberg’s meeting with editors, and the two knew they were going to use it in their story. “So that was one of my first questions [to Osberg]: ‘Did you hold the meeting with the three editors?’ and he said no. I said, ‘You know this is going to be in the newspaper, so I’m going to give you one freebie. I’m going to give you a chance to amend that answer.’”

Again, Osberg denied there was meeting.

Just before ending the interview, Carr gave Osberg yet another opportunity to admit that the meeting took place. He wouldn’t do it.

Carr says: “I asked Amy afterwards, ‘Do you think he choked? Why did he do that?’ We really couldn’t figure it out because word of that meeting was all over the building.”

"Later Wednesday afternoon, Philadelphia Daily News editor Larry Platt said on the record that the meeting took place. “He wouldn’t go into details,” says Carr, “but those we already had.”

Carr then told Block in an email that Platt confirmed the meeting that Osberg said never took place.

“He said, ‘What time are you closing?’ I said 7:30, and so at 7:50 he sent me a 200-word statement from Osberg acknowledging that the meeting had taken place.”

Here is Osberg’s statement to the Times reporters, time-stamped 7:56 p.m.:

I made it very clear in this February 7 meeting, that I was not suggesting ever taking control of the editorial process, nor was I planning to change any reporting policies going forward. Any suggestions to the contrary of that position are categorically denied, as I stated to you during our interview this morning.

What I did tell the editors that attended this meeting is that I would like to be advised before any articles are published on the subject of Philadelphia Media Network’s possible sale, so that as Publisher, I would not be blind-sided by a story publicly, without receiving advance notice. In view of the sensitive subject matter of the sale, as Publisher, I would have the prerogative to make such a request and it would not be uncommon to receive such notification.

Carr called the desk — after his deadline — and told editors about the statement. They were able to add a sentence to the story.

“It made me angry,” says the reporter. “I don’t know if I’ve ever been through something like that before: No, it didn’t happen; no, it didn’t happen; no, it didn’t happen; and then, yes it did.”

The Parties

These complaints were filed by Complainant Proskauer Rose, “one of the largest law firms in the United States,” and by Allen Fagin, Joseph Leccese, and Gregg M. Mashberg. The individual complainants are partners at Proskauer (as its been known since 2000), and have been quoted in various media outlets and named “Super Lawyers” by several publications. They point out that their names appear prominently on the firm’s website and appear in firm promotional materials, and that their names appear on bills sent to clients of the firm.

Respondent Crystal Cox bills herself as an “Investigative Blogger.” According to the Complainants, she shares the views of Eliot Bernstein, who sued Proskauer in 2007 accusing it of “contribut[ing] to the Enron bankruptcy and the presidency of George W. Bush.” She uses the disputed domain names to operate sites that accuse the firm and its attorneys of fraud, theft, corruption, and perjury.

Identical or Confusingly Similar

The Panel finds that Proskauer has rights in the mark PROSKAUER through its registration and use of that mark. The domain name is confusingly similar to Proskauer’s mark, since it merely incorporates the mark and adds the descriptive term “law firm.”

Though individuals can prove trademark rights (even unregistered rights) in their names, the Panel finds that the individual attorneys here failed to do so. The Panel acknowledges that the attorneys are “highly respected, prominent lawyers,” but points out that there is no evidence that they market or provide services independently of the Proskauer firm. Rather, “it appears that the Proskauer firm is the platform on which [they] provide [their] legal services.” Furthermore, there is no evidence that the individual attorneys spent money advertising their names, or billed clients in their own names; nor were they the driving force behind, or the alter ego of, the Proskauer firm.

Cases cited by the Complainants involving trademarks for individual names did not persuade the Panel. Those cases involved a banker whose name was incorporated into the bank name, and a fashion designer who used his personal name in connection with his fashion design business. “The context of an accomplished partner at a prominent, well-known law firm is generally not analogous.”

For those reasons, the Panel finds that the individual attorneys did not have trademark rights in their names sufficient to support a UDRP proceeding.

Rights or Legitimate Interests

“A majority of this Panel maintains that the use of the Domain Name [] here as a genuine ‘gripe site’ vests Respondent with a legitimate interest,” namely, making a fair use of the disputed domain. Though the concept of free speech is not enumerated as a legitimate interest under the Policy, the Panel recognizes that it qualifies as such.

Ultimately, the Panel declines to address these case squarely:

The Panel unanimously believes that this is not a clear case of cyber squatting which the Policy was designed to address. Rather, this looks like a protracted and contentious dispute among numerous parties, several of whom are not before the Panel in this proceeding, that has spilled into the arena of Internet domain names. All parties are free to pursue their respective positions and interests in other fora better suited to consider evidence and grant appropriate relief. As set forth in his concurring opinion, the Panel member who disagrees with the majority’s reasoning on the legitimacy of criticism sites joins the Panel in finding this dispute better suited for the national courts and in the circumstances of this case not appropriate for resolution under the Policy.

In light of the Panel’s decision on the second prong, it declines to consider the third prong.

Commentary

Lawyers are always being told that they are their own “brand”; I guess this Panel doesn’t read the same marketing books I do. So what can a lawyer do to establish trademark rights in an individual name (short of becoming a named partner)?

For the Panel to find in favor of Proskauer, it would have to get around the free speech/fair use issue. Of course, free speech is not unlimited; defamatory statements are not protected by the Constitution. But the limited scope of the UDRP does not allow the Panel to make the fact-intensive determination of whether the Respondent’s statements are defamatory. Though it was likely worth filing these complaints and taking a shot, Proskauer may need a court to find defamation in order to recover the domains. Otherwise, the gripe sites they point to will likely be considered fair uses."
